Legal notice

This Legal Notice governs access to and use of the website https://www.tradilex.es/ (hereinafter, the “website” or the “platform”). Users are advised to read this Legal notice before using the platform.

1. Identification of the website owner

1.1 In compliance with the information obligation established in Article 10 of Law 34/2002 of 11 July on Information Society Services and Electronic Commerce (LSSI-CE), the identifying details of the website owner are provided below:

  • Owner: Universidad Nacional de Educación a Distancia (UNED)
  • Tax Identification Number (NIF): Q2818016D
  • Registered address: Calle Bravo Murillo, 38, 28015 Madrid (Spain)
  • Contact email: tradilex@flog.uned.es

1.2 The Tradilex platform has been developed within the TRADIT Research Group (Didactic Audiovisual Translation), affiliated with the Faculty of Philology, Department of Foreign Languages and their Linguistics at UNED, which acts as the unit responsible for the activity. The project coordinator is Noa Talaván (ntalavan@flog.uned.es).

1.3 The platform is the result of the “TRADILEX” research project, reference PID2019-107362GA-I00, funded by the Spanish Ministry of Science and Innovation and the State Research Agency (MCIN/AEI/10.13039/501100011033).

2. Purpose and nature of the activity

2.1 This Legal Notice governs the general conditions for access to and use of the website, without prejudice to the owner’s right to establish specific conditions applicable to specific services or features, which shall prevail over these general conditions where they conflict with them.

2.2 Tradilex is an educational platform for Didactic Audiovisual Translation (DAT) aimed at language learning. It provides teaching staff and students with teaching resources—including lesson plans and subtitling, dubbing and audio description exercises—that can be used online without the need to install additional software. The platform also includes a subtitle editor and an audio recorder integrated into the browser.

2.3 Access to the platform and its resources is free of charge. The platform has no commercial purpose: it forms part of a publicly funded research project and is intended to disseminate and transfer the knowledge generated within its field.

2.4 The platform allows separate registration of student and teacher accounts, the linking of student accounts to classrooms created by teaching staff through a class code, and the generation of user-generated content (including, among other things, foreign-language production exercises, subtitles and voice recordings) as part of the educational exercises.

3. Conditions of access and use

3.1 User status is acquired simply by accessing the website and, where applicable, by registering an account. Access to and browsing of the website imply knowledge and acceptance of this Legal Notice in the version published at any given time.

3.2 Users undertake to use the website and its content in accordance with the law, this Legal Notice and any other conditions and instructions brought to their attention, as well as in accordance with the principles of good faith and public order. In particular, users shall refrain from:

  • using the website for unlawful purposes or in a manner that harms the rights and interests of third parties;
  • introducing or disseminating insulting, defamatory or discriminatory content or content contrary to human dignity;
  • introducing programs, viruses or any other element capable of damaging the systems of the owner or third parties;
  • accessing or attempting to access restricted resources or areas without authorization, or using another user’s credentials;
  • reproducing, distributing or modifying the content of the website outside the circumstances expressly permitted.

3.3 Users are responsible for the truthfulness and accuracy of the information they provide and for the proper safeguarding of their access credentials. The owner may suspend or cancel accounts that breach this Legal Notice or the Terms and Conditions of Use, under the terms established therein.

4. Intellectual and industrial property

4.1 The distinctive signs (including the name “Tradilex” and the logos), as well as the structure, design and source code of the website, are owned by the owner or by third parties who have authorized their use and are protected by intellectual and industrial property legislation. Any unauthorized reproduction, distribution or modification is prohibited.

4.2 The content and teaching resources published by the owner are made available to teaching staff and students for educational purposes. Where a resource is distributed under an open licence, the terms of the specific licence accompanying each resource shall prevail, in accordance with the Open Science policy of the Spanish Ministry of Science and Innovation.

4.3 Users retain ownership of the rights in the works they create on the platform (subtitles, voice recordings and other productions). By storing or publishing such works on the platform, users grant the owner a free-of-charge, non-exclusive and revocable licence, limited to hosting, reproducing and communicating such works to the extent strictly necessary for the provision of the educational service and the assessment of the exercise. Any use beyond this purpose—in particular, use for scientific research or dissemination purposes—shall require the user’s prior, specific and informed consent, in accordance with the terms of the Privacy Policy.

5. Links and third-party content policy

5.1 The website may include links to third-party websites or incorporate content hosted by third parties (for example, embedded videos). The owner assumes no responsibility for the content, services or policies of such third parties, for which they are solely responsible.

5.2 The inclusion of links does not imply any recommendation of or affiliation with the linked website. Users wishing to create a link to the website shall refrain from reproducing its content, creating confusion as to the origin of the service, or making false or inaccurate statements about the owner.

6. Personal data protection

6.1 The processing of personal data collected through the website is governed by the Privacy Policy, which is permanently accessible from the website and to which this Legal Notice refers.

6.2 The data controller is Universidad Nacional de Educación a Distancia (UNED), through the TRADIT Research Group. The main legal basis for processing is the performance of a task carried out in the public interest (Article 6(1)(e) GDPR), without prejudice to other legal bases applicable to specific purposes—such as consent, performance of the relationship with the user or compliance with a legal obligation—which are detailed in the Privacy Policy.

6.3 Users may exercise their rights of access, rectification, erasure, objection, restriction of processing and data portability, by contacting the Data Protection Officer at dpd@adm.uned.es or at the Electronic Portal of the UNED.

7. Cookie policy

7.1 The website uses cookies and similar technologies under the terms described in the Cookie Policy, to which this Legal Notice refers.

7.2 Users may accept, reject or configure non-essential cookies on a granular basis through the consent panel available on the website, and may withdraw their consent at any time through the permanent configuration icon.

8. Limitation and exemption of liability

8.1 The owner endeavours to keep the website available and up to date but does not guarantee uninterrupted availability or continuity. The owner shall not be liable for interruptions, errors or failures arising from causes beyond its reasonable control or from force majeure.

8.2 The owner endeavours to ensure that the information published is accurate and up to date but shall not be liable for any inaccuracies or omissions, without prejudice to correcting them once detected.

8.3 The owner is not responsible for content generated or disseminated by users, responsibility for which lies with those who create or publish it, without prejudice to any measures the owner may take in accordance with the Terms and Conditions of Use.

8.4 The foregoing limitations are without prejudice to consumer and user protection legislation and to any liability that cannot legally be excluded.

9. Amendments to the Legal Notice

9.1 The owner may amend this Legal Notice to adapt it to regulatory, technical or changes in the platform’s activities. Amendments shall take effect upon publication on the website.

9.2 Users are advised to consult this Legal Notice periodically. Where an amendment materially affects the conditions of use or the processing of data, users will be informed through the means available on the platform.

10. Applicable law and jurisdiction

10.1 This Legal Notice is governed by Spanish law.

10.2 As the owner is a public-law entity, disputes concerning acts subject to administrative law shall fall within the jurisdiction of the competent administrative courts. For other relationships, jurisdiction shall lie with the courts and tribunals having jurisdiction under applicable law.

10.3 The foregoing is without prejudice to the rights granted by consumer and user protection legislation (Royal Legislative Decree 1/2007 of 16 November) to persons qualifying as consumers, including, where applicable, the jurisdiction corresponding to their domicile.

Effective as of its publication on the website.
